In accordance with Articles 16 and 17 of the Federal Law on Protection of Personal Data Held by Private Parties, we inform you that MEXICO CULTURAL "THE AGENCY," with address at Calle Colinas del Sur, Álvaro Obregón, CDMX, C.P. 01430, will process the personal data it collects from you through various means or, as the case may be, through the company's website: https://mexicocultural.mx/ — and via apps such as Facebook, WhatsApp, among others. We therefore ask you to carefully read the Terms and Conditions contained in this document, as your provision of personal and/or sensitive data constitutes acceptance of these Terms and Conditions.

The terms "Personal Data" and "Sensitive Data" are defined in Article 3 of the Law.

For what purposes will we use your personal and/or sensitive data?

MEXICO CULTURAL is responsible for the management of personal data provided by you, as well as for its use and protection. In the exercise of this notice, the company may, among other things, manage, share, store, transfer, and make available to authorities or third parties as applicable and under applicable conditions. The personal data we collect about you is necessary to verify and confirm your identity, as well as to administer and operate commercial, tax, labor, banking, and other contracting processes; to fulfill obligations arising from the commercial relationship; to provide services; to offer information, services, products, and/or promotions; to send requested quotes; to provide advisory and/or consulting services; administration, logistics, distribution, supervision; to register your information in systems and databases; to generate physical and/or electronic files; payment management and transfers; to generate studies and/or statistics that allow us to adjust our services, products, or business models; to contract services; to handle, follow up on, and resolve any request or complaint; to confirm, correct, and update your personal information; to provide customer service; to clarify doubts or complaints about our products and/or services; to facilitate the use of our website and simplify your experience on our page; to handle your Access, Rectification, Cancellation, and Opposition (ARCO) requests as well as Consent Revocation; to notify any changes to this privacy notice, among others.

What personal and/or sensitive data do we collect and use?

MEXICO CULTURAL may collect, in an enumerative but not limiting manner, and where applicable, process the following personal and/or sensitive data: full name, telephone number, R.F.C. (tax ID), voter ID (INE), articles of incorporation, notarized power of attorney of the legal representative and proxy if applicable, bank statements, credit history, proof of address, email address, official IDs, bank details, age, photographs, videos, social media accounts, emails, photographs, and in general any data that is necessary to the company depending on the matter at hand.

With whom do we share your personal data?

As a result of MEXICO CULTURAL's commercial relationship, we may share your personal data for possible transmissions or transfers to third parties, both national and international, involved in the provision of services requested by you. We inform you that these companies operate under privacy policies that comply with applicable regulations.

In any case, we will communicate this privacy notice to the recipients of your personal data so that they respect its terms.

We also state that your data will be stored in various secure media that technology allows, access to which will be limited solely to individuals and/or legal entities with which "THE COMPANY" has a legal relationship.

How can you access, rectify, or cancel your personal data, or object to its use?

You have the right to: access your personal data held by us and learn the details of its processing; rectify it if it is inaccurate or incomplete; cancel it when you consider it is no longer required for any of the purposes indicated in this privacy notice, is being used for purposes not consented to, or when the contractual or service relationship has ended; and to object to its processing for specific purposes, as provided by law (collectively, "ARCO Rights").

To exercise your ARCO Rights, you must submit a request (the "ARCO Request") to the data controller, to the attention of the Personal Data Protection Department, at the Contact Address, accompanied by the following information and documentation:

  • Your name, address, and email address so that we can communicate the response to your ARCO Request.
  • A copy of documents proving your identity (copy of voter ID, passport, or any other official ID), or documentation proving your legal representation, whose original must be presented in order to receive the data controller's response.
  • A clear and precise description of the personal data regarding which you wish to exercise one of the ARCO Rights.
  • Any document or information that facilitates the location of your personal data.
  • In the event of requesting a rectification of your personal data, you must also indicate the modifications to be made and provide supporting documentation for your request.

The Personal Data Protection Department will respond to your ARCO Request and the reasons for its decision by email within a maximum of 20 business days from the day the ARCO Request was received. If the ARCO Request is answered affirmatively or is deemed appropriate, the requested changes will be made within a maximum of 15 business days. The data controller may notify you within the deadlines referred to in this paragraph of an extension of the same, once only, for a period equal to the original.

The data controller may deny access (the "Denial") so that you exercise your ARCO Rights in cases permitted by law, and must inform you of the reason for such a decision. The Denial may be partial, in which case the data controller will carry out the access, rectification, cancellation, or opposition to the extent applicable.

We inform you that our website does not use tracking technologies through which it is possible to monitor your behavior as an Internet user.
